Please read these Terms and Conditions ("Terms") carefully before using the Pivotal Parenting website, subscription services, digital platform, or any related products or services (collectively, the "Services") operated by Pivotal Parenting Support, LLC ("Pivotal Parenting," "we," "us," or "our").

 

By accessing or using our Services, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you do not agree, please do not use our Services.

 

1. About Pivotal Parenting

Pivotal Parenting provides clinically-informed subscription box products and digital tools designed to support families raising children with neurodevelopmental differences, including Autism Spectrum Disorder (ASD) and related conditions. Our products are curated by Board Certified Behavior Analysts (BCBAs), Speech-Language Pathologists (SLPs), and Occupational Therapists (OTs).

 

IMPORTANT MEDICAL DISCLAIMER: Pivotal Parenting products and Services are designed to complement — not replace — professional therapy, medical care, or clinical treatment. Nothing in our Services, website, platform, activity guides, or product descriptions constitutes medical advice, a clinical diagnosis, or a treatment recommendation. Always consult your child's licensed healthcare providers before making decisions about your child's care.

 

2. Accounts and Eligibility

To purchase a subscription or access the Milestones Platform, you must:

  • Be at least 18 years of age;

  • Be the parent or legal guardian of the child for whom you are creating a profile;

  • Provide accurate, complete, and current account information;

  • Maintain the security of your account credentials.

 

You are responsible for all activities that occur under your account. Notify us immediately at support@pivotalparenting.com if you suspect unauthorized access to your account.

 

We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity.

 

3. Subscription Services

3.1 Subscription Tiers

Pivotal Parenting offers subscription tiers including, but not limited to:

  • Monthly delivery of BCBA-curated sensory and developmental products;Standard Subscription: 

  • Enhanced subscription with clinical consultation components (availability may be limited).Therapeutic Tier: 

 

Current pricing, tier descriptions, and available options are displayed at checkout and on our website. Pricing is subject to change with 30 days' advance notice to active subscribers.

3.2 Billing and Autorenewal

By subscribing, you authorize Pivotal Parenting to charge your payment method on a recurring monthly basis until you cancel.

  • Charges occur on the same calendar date each month (or the closest business day);

  • Prepaid plans are charged in full at the time of purchase;

  • Your subscription will automatically renew each month unless you cancel before the renewal date.

 

You can manage billing and update payment information in your account dashboard at any time.

3.3 Cancellation Policy

You may cancel your subscription at any time through your account dashboard or by contacting support@pivotalparenting.com. To avoid being charged for the next billing cycle, you must cancel at least 3 business days before your next renewal date.

 

Upon cancellation:

  • Your subscription will remain active through the end of the current billing period;

  • No partial refunds are issued for unused days in the current billing period;

  • Prepaid subscriptions are non-refundable after the first box has shipped.

3.4 Refund Policy

We want every family to be delighted with their Pivotal Parenting box. If you are unsatisfied:

  • Contact us within 14 days of delivery. We will replace the item or issue a credit at no charge;Damaged or defective items: 

  • If your box is confirmed undelivered by our shipping partner, we will reship or refund at your choice;Non-delivery: 

  • Please contact us within 7 days of delivery. We review requests on a case-by-case basis and will work to make it right;General dissatisfaction: 

  • New subscribers who are unsatisfied with their first box may receive a full refund if requested within 14 days of delivery.First-box guarantee: 

 

Refund requests should be submitted to support@pivotalparenting.com with your order number and a description of the issue.

3.5 Subscription Pausing

You may pause your subscription for up to 3 months in any 12-month period through your account dashboard. Paused subscriptions will resume automatically at the end of the pause period unless you cancel or extend the pause.

 

4. Products — Safety and Appropriate Use

All Pivotal Parenting products are clinically selected and tested for age-appropriateness. However:

  • You are responsible for determining whether any product is appropriate for your individual child, taking into account your child's specific needs, sensory profile, and any guidance from their therapists;

  • Always supervise children during play, especially with sensory items, small parts, or fidget tools;

  • Age range recommendations on products are developmental, not chronological. Use your judgment;

  • If your child's therapist advises against any item included in a box, please contact us and we will arrange a replacement;

  • Pivotal Parenting is not liable for injury or adverse outcomes resulting from unsupervised use or misuse of products.

 

All products comply with CPSC safety standards and applicable CPSIA testing requirements. Product safety documentation is available upon request.

 

5. Intellectual Property

All content on the Pivotal Parenting website and platform — including activity guides, BCBA-authored educational materials, product descriptions, branding, logos, and platform software — is the intellectual property of Pivotal Parenting Support, LLC and is protected by copyright, trademark, and other applicable laws.

 

You may not copy, reproduce, distribute, publish, or create derivative works from our content without our prior written permission, except for personal, non-commercial use in supporting your own child's development.

 

6. User-Generated Content

If you submit reviews, testimonials, progress updates, photos, or other content through our platform or social media channels tagged with our brand, you grant Pivotal Parenting a non-exclusive, royalty-free, worldwide license to use, display, and share such content for marketing and promotional purposes.

 

You represent that you own or have the right to share any content you submit, and that the content does not violate any third-party rights or applicable laws. You may revoke this license at any time by contacting us.

 

Please do not submit any content that includes identifiable images or personal information about children without ensuring you have the appropriate consent.

 

7. Prohibited Uses

You agree not to use our Services to:

  • Impersonate any person or entity or misrepresent your affiliation;

  • Submit false or misleading information about yourself or your child;

  • Attempt to gain unauthorized access to our platform, accounts, or systems;

  • Scrape, harvest, or otherwise extract data from our website or platform;

  • Use our Services for any unlawful purpose;

  • Resell, redistribute, or commercially exploit our products or subscription content.

 

8. Disclaimers and Limitation of Liability

8.1 No Medical or Clinical Advice

Our Services, products, activity guides, and platform content are for informational and developmental support purposes only. They do not constitute medical advice, diagnosis, or treatment. Pivotal Parenting is not a healthcare provider. Always consult qualified professionals for clinical decisions.

8.2 Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement.

8.3 Limitation of Liability

To the fullest extent permitted by law, Pivotal Parenting's total liability to you for any claim arising from or related to these Terms or our Services shall not exceed the greater of (a) the total amount you paid to us in the 12 months preceding the claim, or (b) $100.

 

Pivotal Parenting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or personal injury, arising from your use of our Services or products.

 

9. Indemnification

You agree to indemnify and hold harmless Pivotal Parenting, its officers, employees, contractors, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of our Services, or your violation of any third-party rights.

 

10. Dispute Resolution

10.1 Informal Resolution

Before initiating formal proceedings, you agree to contact us at legal@pivotalparenting.com to attempt to resolve any dispute informally. We will make good-faith efforts to resolve disputes within 30 days.

10.2 Binding Arbitration

If informal resolution fails, disputes shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in Los Angeles County, California, or virtually by mutual agreement.

 

You and Pivotal Parenting each waive the right to a jury trial and to participate in class action litigation. You may opt out of arbitration by sending written notice to legal@pivotalparenting.com within 30 days of first agreeing to these Terms.

10.3 Exceptions

Either party may bring claims in small claims court. Either party may seek emergency injunctive relief in court to prevent irreparable harm pending arbitration.

 

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any court proceedings (where arbitration does not apply) shall be brought exclusively in the courts of Los Angeles County, California.

 

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email and display a prominent notice on our website at least 30 days before changes take effect. Your continued use of our Services after the effective date constitutes acceptance of the updated Terms.
